Heard learned counsel for the applicant, learned A.G.A. and perused the entire record of the case.
The submission of learned counsel for the applicant is that the present case was lodged on 2.8.2009, by the complainant. Accused applicant is named in the FIR and the complainant was informed of his name by the villagers. It is further submitted that, as alleged, the accused applicant was arrested on 23.8.2009 and from his house, one gas cylinder and two sarees were recovered. He further submits that the recovered articles belong to the applicant and the applicant has falsely been implicated in the present case. It is further submitted that the offences so levelled are triable by Magistrate.The applicant is in jail since 23.8.2009, as mentioned in para 11 of the bail application, which has not been controverted by the State.
Considering the overall aspects of the matter, I hereby provide that the applicant be released on bail in Case Crime No.534 of 2009, under Sections 457, 380, 411 IPC, P.S. Mohammadpur Khala, District Barabanki, on his filing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned.
