Supplementary affidavit filed by learned counsel for the applicant is taken on record.
Heard Sri Ajay Kumar Pathak, learned counsel for the applicant and Sri I.P. Srivastava, learned A.G.A. for the State and perused the record.
It has been contended by the learned counsel for the applicant that the identity of the applicant in the present case is a disputed one and the victim too has deposed before the trial court that the applicant has not committed the said crime and she was declared hostile. The applicant is in jail since 14.3.2016.
Learned A.G.A. have vehemently opposed the prayer for bail.
Without expressing any opinion on the merits of the case and considering the submission advanced, I find no good ground for grant of bail to the applicant Raju involved in Case Crime No. 541 of 2015 under Sections 363, 366, 376(D) I.P.C. read with Section 4 of the Protection of Children from Sexual Offences Act, 2012, police station Sikandra, District Hathras.
Accordingly, the bail application is rejected.
However, the trial court is directed to expedite the trial of the aforesaid case and conclude the same within preferably a period of four months from the date of production of a certified copy of this order, if, there is no legal impediment.
