Heard counsel for the petitioner and AGA for State.
The writ petition has been filed for quashing the FIR dated 7.12.2018 registered as Case Crime No. 202 of 2018, under Section 498 A, 304 B IPC and Section 3/4 D.P. Act, P.S. Debhrua, Distt. Siddharth Nagar.
In substance, in the FIR the allegation has been made that daughter of the informant namely Neetu was married to Raju four years ago. The accused were not satisfied with the dowry given at the time of marriage and they were demanding Rs. 1 lakh cash and one she buffalo. On 30.11.2018, the petitioners was given information that his daughter had died. When the informant made inquiry in respect of death of his daughter then it was found that son in law of the informant namely Raju had assaulted and sent the decease to his house and instructed his parents to give poison to Neetu. Thereafter his parents had given poison to her.
We have considered the arguments of the counsel for the parties.
A perusal of the FIR shows that it discloses the offence as such it is not liable to be quashed.
However, if the petitioners surrender and apply for bail then same shall be considered and decided expeditiously, in accordance with law.
The writ petition is disposed of.
