1. Heard Sri Akhilesh Kumar, learned counsel for petitioner and learned Standing Counsel for State-respondents.
2. Grievance of petitioner is that proposed society namely, Matsya Jivi Sahkari Samiti Maura/Jadauda Panda is to be constituted, for which petitioner has submitted an application to respondent-3 i.e. Assistant Director Fisheries, Saharanpur but he is not taking steps for ensuring registration of said Society.
3. We repeatedly asked learned counsel for petitioner as to under which provision Officers of Fisheries Department are obliged to get registration of proposed Co-operative Society, inasmuch as, under U.P. Co-operative Societies Act, 1965, an application for registration of a society is to be made in the manner prescribed to Registrar after complying with other formalities for such incorporation, but he could give no reply.
4. In our view, Officer of Fisheries Department neither have any obligation nor otherwise are required to themselves ensure constitution of a Co-operative Society at any particular place.
5. In view thereof, this writ petition is thoroughly misconceived. Dismissed accordingly.
