Heard learned counsel for the parties and the learned A.G.A. for the State.
This petition is filed by the applicants for quashing the charge sheet no. 01 of 2016 dated 20.1.2016 as well as cognizance order dated 21.1.2017 passed by the learned Additional Chief Judicial Miagistrate, Shikohabad, District Firozabad, in Criminal Case No. 298 of 2017, (State Vs. Raju and others) arising out of Case Crime No. 165 of 2015, under Sections 323, 324, 325, 308, 504 & 506 I.P.C., P. S. Fariha, District Firozabad.
After arguing at some length, learned counsel for applicants submits that grievance of applicants would be sufficiently met in case bail application of applicants is considered expeditiously in accordance with law.
In view thereof, it is provided that if the applicants surrenders before the Court below within three weeks from today and applies for bail, the Court below will consider the same, in accordance with law in view of the observations made in the case of Lal Kamlendra Pratap Singh Vs. State of U.P. reported in [2009 (3) ADJ 322 (SC)].
For a period of three weeks, no coercive steps shall be taken against the applicants.
With the aforesaid, the petition is disposed of.
