The case has been called out twice.
None has appeared on behalf of the petitioner to press this petition.
Sri S.P. Singh learned ASGI Union of India along with Sri Vinay Singh are present.
It is informed that the petitioner is in unlawful occupation of the premises and he is not also making any payments either towards rent or other enmities. We had adjourned the matter on 25th May, 2018 to enable the Court to be informed about the status of the claim of the petitioner for appointment under the dying in harness rules.The petition assails the consequential recovery proceedings.
On this, the learned ASGI informs the Court that there are many more people waiting seeking compassionate appointment over and above the petitioner, and in such circumstances, the said consideration may take time, but so far as, the occupancy of the premises is concerned, the petitioner has been occupying it for almost 12 after the retirement of his father who died two year ago.
In the aforesaid circumstances, we see no reason to entertain this writ petition, the same is dismissed in default.
