Heard Sri Istiyaq Ali, learned counsel for the applicant and learned A.G.A. for the State.
This is the third bail application of the applicant. The first two bail applications of the applicant were rejected by this Court vide orders dated 3.9.2014 and 10.8.2017 passed in Criminal Misc. Bail Application nos. 28398 of 2014 and 12527 of 2016 with a direction to the trial court to expedite the trial of the aforesaid case and conclude the same within a period of six months, if there is no legal impediment but the same has not been concluded till date and the applicant is languishing in jail since 8.6.2010.
Learned A.G.A. opposed the prayer for bail and submitted that the applicant was also involved under the N.D.P.S. Act and he has already been convicted by the trial court for the offence under Section 20 of the N.D.P.S. Act, thereafter the applicant was granted bail in the said case. After releasing from the bail the applicant has preferred an appeal before the competent court.
Learned counsel for the applicant has failed to make out any new ground for enlarging the applicant on bail at this stage hence, the second bail application of the applicant is rejected at this stage.
However, the trial court is directed to conclude the trial of the applicant on day-to-day basis within a period of four months from the date of production of certified copy of this order before the trial court.
The applicant is directed to produce the certified copy of this order before the trial court for its compliance.
