The prayer in this petition is to direct the second respondent (District Magistrate, Banda) to restrain Respondent Nos. 4 and 5 who are private individuals, from making pathways on plot No. 300/3 and 371 of the petitioners at village Benda, tehsil and district Banda.
As the dispute in the present petition is between private persons in respect of property rights, the appropriate course for the petitioner is to institute a civil suit.
We, therefore, decline to entertain this petition while leaving it open for the petitioners to institute a civil suit or take recourse to such other legal civil remedies as may be advised.
Subject to above, the petition is disposed of.
