Heard learned counsel for the petitioners and learned AGA for the State.
The present petition has been filed by the petitioners with the prayer to effect and operation of the order dated 06.07.2019 passed by Additional Sessions Judge, Court No. 6, Farrukhabad in Criminal Revision No. 240 of 2016 as well as Complaint Case No. 772 of 2016 (Shabnam Vs. State of U.P. and others), under Section 354, 323, 452, 504, 506, 307 IPC.
Initially complaint was rejected under Section 203 Cr.P.C. A criminal revision was filed by the opposite party no. 2 by the complainant, which was allowed and setting aside the order dated 02.09.2016 passed under Section 203 Cr.P.C. concerned Magistrate was directed to pass afresh order. Petitioners are the accused person. Since no order has been passed till today on the complaint in compliance of the judgment and order dated 06.07.2019 passed in the criminal revision, at this stage, grounds taken in the petition are not sufficient to exercise extraordinary jurisdiction. Petition being devoid of merits is not liable to be allowed.
