Heard learned counsel for the appellant- Ajay @ Sarwan and the learned A.G.A. for the State of U.P.
Learned counsel for the appellant submits that the appellant- Ajay @ Sarwan has been in jail since 1.7.1995 i.e. for a period of about nineteen years and two months. The other co-accused persons namely; Raju Gupta @ Ratan alias Suraj and Deepak were enlarged on bail by another Bench of this Court. There is no identification of the appellant-Ajay @ Sarwan.
Per contra, learned A.G.A. opposed the prayer for bail and submitted that the injuries were caused by the appellant- Ajay @ Sarwan, who was a hired killer. The role of hurling bomb was assigned to the appellant, who belongs to district Allahabad. The appellant hurled bomb on the deceased, who was an advocate, in the court premises also causing injuries to other two advocates. When the appellant and two other co-accused were running away on motorcycle after committing the crime they were caught hold of by the police.
Having given our thoughtful consideration, without expressing any opinion on the merits of the case, in this background we decline to grant bail to appellant-Ajay @ Sarwan at this stage.
The prayer for bail is rejected.
Hearing of the appeal is expedited. Office to prepare the paper book within three months and to list the appeal thereafter for hearing before the appropriate Bench.
