Heard learned counsel for the parties.
Petitioner by the instant writ petition, seeks following relief:
"to issue a writ, order direction in the nature of mandamus commanding the respondent authority/respondent no.5 to appoint the petitioner on the post of Aganbari Karyakatri in pursuance of advertisement dated 2.11.2011 issued from office of respondent no. 5 for making appointment on the post of Aganbari Karyakatri at village Taraiya."
Petitioner had earlier approached this Court by filing petition bearing Writ-A No.27934 of 2018, which came to be dismissed on 7 January 2019. The order reads thus:
"This petition has been preferred primarily seeking the following relief:-
"Issue a writ, order or direction in the nature of mandamus commanding the respondent authority/respondent no.5to appoint the petitioner on the post of Aganbari Karyakatri in pursuance of advertisement dated 02.11.2011 issued from the office of respondent No.5 for making appointment on the post of Aganbari Karyakatri at village Taraiya."
The claim as raised in the writ petition rests solely upon the empanelment of the petitioner in a selection process which was undertaken in 2011.
Despite repeated queries of the Court, learned counsel for the petitioner was unable to draw the attention of the Court to any provision in terms of which this empanelment made in 2011 would remain effective and subsist on date.
Consequently the Court finds no ground to issue the writs as prayed for.
Writ petition is dismissed."
The second writ petition, on the same fact and relief would not be maintainable.
In the circumstances, the writ petition being mis-conceived is, accordingly, dismissed.
