Heard Sri Arjun Singh Yadav, learned counsel for the applicant and learned A.G.A. for the State and perused the material placed on the record.
Applicant-Raju alias Neeraj Paswan seeks bail in Case Crime No.39 of 2018, under Sections 376, 506 I.P.C. and 3/4 of The Protection of Children From Sexual Offences Act, Police Station Asothar, District Fatehpur.
Keeping in view the nature and gravity of allegations made in the F.I.R. regarding rape on a young girl of about 14-15 years which finds full support from the injuries sustained by the victim inasmuch as there are multiple abrasions on her back and her hymen was torn and bleeding was present and the fact that the victim has supported prosecution version of rape in her statement recorded under Section 164 Cr.P.C., I do not find any ground to consider the prayer for bail of the applicant. The prayer for bail is declined at this stage.
The application for bail is, hereby, rejected without expressing any opinion on the merit of the case.
