Rajrani vs State Of U.P. Thru. Addl.Chief ...

High Court Of Judicature at Allahabad|26 May, 2021

JUDGMENT / ORDER

Hon'ble Ajai Kumar Srivastava-I,J.
Heard learned counsel for petitioner, learned Additional Chief Standing Counsel for the State and Sri Rakesh Kumar Chaudhary who has put in appearance on behalf of State Election Commission through video conferencing.
Admittedly, the result of election has already been declared on 2.5.2021. The petitioner has alternative remedy of filing election petition under Section 12-C of U.P. Panchayat Raj Act, 1947.
Thus, we decline to entertain this writ petition under Article 226 of the Constitution of India on the ground of alternative remedy being available to the petitioner. In case the petitioner files an election petition within the period of limitation, the same shall be adjudicated upon without giving rise to any grievance of inordinate delay and proceedings shall be brought to its logical conclusion expeditiously in accordance with law.
The petition is disposed of.
