Heard learned counsel for the petitioner and the learned AGA.
In pith and substance, the petitioner is before this Court asking his application dated 13.8.2021 and 19.8.2021 (Annexure No. 2 and 4) may be decided.
At the very outset, learned AGA raised an objection that in case the aforementioned application is not being entertained by the competent authority, the petitioner has got efficacious alternative remedy under Section 156(3) Cr.P.C. and as such, the present writ petition is liable to be dismissed on the ground of statutory alternative remedy.
In the facts and circumstances, the Court has proceeded to examine the record and is of the considered opinion that once the efficacious alternative remedy is available to the petitioner, there is no reason or occasion to bypass the statutory forum and the writ petition is liable to be dismissed on the ground of statutory alternative remedy.
Once the Court has declined to interfere, learned counsel for the petitioner fairly states that he does not want to press the writ petition and the same may be dismissed as not pressed with the liberty to seek appropriate remedy.
Consequently, the writ petition stands dismissed as not pressed with the aforesaid leave.
