In this public interest litigation, prayer of the petitioner is to issue a writ in the nature of mandamus commanding respondent nos. 2 to 4 to provide land for Primary Schools, Ambedkar Park, Play Ground, Hospital, Community Hall, Graveyard, Chak Road and Nali in village Shivapar for use of the villagers. Further prayer of the petitioner is to issue a writ in the nature of mandamus commanding respondent no.3 to decide the representation dated 206.2009.
Having heard Mr. Deepak K. Jaiswal for the petitioner, Mr. Saxena, Standing Counsel for the State, and taking into consideration the facts and circumstances of the case, we are of the opinion that the relief sought for by the petitioner can effectively and appropriately be considered by respondent no.3, the Deputy Director of Consolidation, Jaunpur.
In that view of the matter, we are of the opinion that the representation dated 26.06.2009 filed by the petitioner be considered by respondent no.3 in accordance with law.
We direct accordingly.
It is made clear that we have not expressed any opinion in regard to the claim made by the petitioner or merit of the case and that shall be considered and decided by respondent no.3 in accordance with law.
Writ petition stands disposed of with the observation aforesaid.
