Heard Sri Kartikeya Saran, learned counsel for the petitioner and learned Standing Counsel for the State.
The petitioner is fair price shop dealer of Village panchayat Kutubpur Sarai, District Kasganj. The fair price shop licence of the petitioner was suspended by order dated 9.5.2018 on the foot of certain allegations of malpractices and irregularities in the distribution of essential commodities.
The petitioner has assailed the order of suspension. The only prayer made at this stage by Sri Kartikeya Saran, learned counsel for the petitioner is that the petitioner is willing to submit a reply to the show cause notice refuting the charges therein. The petitioner wishes to join the enquiry and clear his name since he has committed no malpractices and his record is clean.
However, apprehension of the petitioner is that the authority may keep the matter pending indefinitely. His sole prayer is that the authority may decide the matter finally within a stipulated period of time.
Learned Standing Counsel has no serious objection in this regard.
It is open to the petitioner to submit a reply to the show cause notice along-with evidence in support, if any, to the licensing authority within a period of four weeks from today. In case the aforesaid reply is submitted to the respondent no.2 or any other authority before whom matter is pending along-with certified copy of this order, he shall decide the same on merits by a reasoned and speaking order in accordance with law within a period of six weeks thereafter.
It is clarified that in case the petitioner fails to submit his reply to the show cause notice within the aforesaid period, this order shall become inoperative.
The writ petition is disposed of finally with the aforesaid directions.
