This writ petition has been filed with a prayer that the petitioner may be allowed to file an appeal before the respondent No. 2 as his wife who was the fair price shop dealer had died after the order of cancellation was passed.
Learned counsel for the petitioner states that since the petitioner would have been a dependent of the deceased wife he had a right to file the appeal.
Under such circumstances, if the petitioner files an appeal the same shall be entertained only after the appellate court concludes that the petitioner had a locus standi to file the appeal. If the appellate authority concludes that the petitioner had the locus standi to file the appeal the same would be decided within two months thereafter.
With these observations this writ petition is, accordingly, disposed of.
