Heard learned counsel for the applicant, learned AGA for the State and perused the record.
This application under Section 482 CrPC has been filed by the applicant with a prayer to direct the Additional Court No.3, Gautam Budh Nagar to decide the Complaint Case No. 516 of 2019 (Rajpal Singh Vs. Manjula Sarees Firm), under Section 138 of Negotiable Instruments Act, Police Station Sector 49 Noida, District Gautam Budh Nagar within stipulated period.
Learned counsel for the applicant has submitted that the applicant in the present case is the complainant and had instituted a complaint under Section 138 of the Negotiable Instruments Act on 18.07.2015, however, the said complaint has not yet been disposed of and the proceeding has been lingering-on, on one pretext or the other.
In view of the provision of Section 143(3) of the Negotiable Instruments Act, learned Additional Court No.3, Gautam Budh Nagar is directed to make all endeavours to decide the aforesaid case as expeditiously as possible, preferably within a period of four months from the date of filing of certified copy of this order without giving any unnecessary adjournments to either parties and there is no other legal impediment in deciding the aforesaid case.
With the aforesaid direction, this application under Section 482 CrPC is finally disposed of.
