Heard learned counsel for the petitioner; learned Standing Counsel for the respondents and perused the record.
The present petition has been filed for a direction upon the District Magistrate, Amroha to grant firearm license to the petitioner within a stipulated period.
The case of the petitioner is that earlier he was granted firearm license of Rifle but as the petitioner was involved in a criminal case, therefore, the license was cancelled by the District Magistrate on 24.06.2015. It is further submitted that ultimately the criminal case was decided and the petitioner was exonerated from the said case thereafter he had preferred an Appeal before the Commissioner. The said Appeal was allowed vide order dated 27.10.2016 with the direction to the District Magistrate for restoration of arm license of the petitioner. It is further stated that the petitioner has approached the District Magistrate along with the order of Commissioner on 10.11.2016 but till date the same has not been decided.
Considering the facts and circumstances of the case, the petition is disposed of with a direction to District Magistrate, Amroha to decide the application of the petitioner strictly in accordance with law within a period of three months from the date of production of certified copy of this order.
It is made clear that the Court has not adjudicated the case on merits.
