Heard learned counsel for the applicant, learned AGA and perused the record.
By means of this application, the applicant who is involved in case crime no. 474 of 2017, In S.T. No. 385 of 2017, under Section 302 IPC, P.S. Karahal, District- Mainpuri is seeking enlargement on bail during the trial.
It is submitted by the learned counsel for the applicant that the deceased Dolly, who is the second wife of the applicant, committed suicide. The FIR came into existence on 03.09.2017 though the incident said to have taken place on 01.09.2017 around 11:30 p.m. The FIR was initially registered under section 498-A, 304-B IPC and 3/4 D.P. Act. It is undisputed that the deceased had died at the resident of the applicant. There is 100% burn injury over her person. There is an eye witness account of the incident. She was murdered brutally by pouring kerosene oil over her body. The applicant is sole and lone named accused in the FIR.
Under the circumstances, I do not find any good reason to grant indulgence to the applicant. Thus, the bail application stands rejected.
It is expected from the learned trial Judge to gear up the trial and try to conclude the same within a period of one year. It is directed that the applicant would render all necessary co-operation in early conclusion of the trial.
Let a copy of this order may be served by the office to the court concern within 15 days from the production of certified copy of this order.
