By way of present revision application, the applicant has prayed to quash and set aside the impugned order dated 11th October, 2011 passed by the learned Principal Judge, Family Court No.3, Ahmedabad in Criminal Miscellaneous Application No.768 of 2007.
Heard Mr.V.M. Gamara, learned counsel for the applicant and Mr.Umang Oza, learned counsel for respondent No.1. The learned Judge has vide his impugned order directed the applicant-husband to pay maintenance amount of Rs.3,000/- per month to respondent No.1-wife from 21st March, 2007 to 11th October, 2011. It is true that the said order is challenged by the applicant by way of present revision application, but till now the applicant-husband has not paid any amount to respondent No.1-wife. By now almost three-and-half-years has passed and approximately respondent-State.01,50,000/- has to be paid by the applicant-husband to respondent No.1-wife.
On condition of depositing 50% amount of maintenance as ordered by the Family Court from 21st March, 2007 to 11th October, 2011, the office is directed to issue Notice, returnable 02nd July, 2012. The applicant is directed to deposit the said amount before the concerned Family Court.
