Learned advocate Mr. Himanshu Patel appears and waives service of rule for respondent No. 1.
2. The present civil application has been filed for bringing the heirs of deceased appellant-Jethvabhai Motibhai Patel on record in view of the reasons and the grounds mentioned the application. It is stated, inter alia, that the appeal has been filed by the father of the applicants, who has now expired and and opponents Nos. 2 & 3 are married daughters.
3. Heard learned advocate Mr. Pandya for learned advocate Ms. Pourami Sheth for the applicants and learned advocate Mr. Himanshu Patel for respondent No.1-Corporation.
4. In the fact sand circumstances and also in view of the grounds mentioned in para 3, as the applicants are the heirs of deceased appellant-Jethvabhai Motibhai Patel for which the death certificate is also produced, the present application deserves to be allowed. Prayer in terms of para 6(d) is granted. The applicants are permitted to be joined as legal heirs and representatives of deceased appellant Jethvabhai Motibhai Patel. The learned advocate for the applicants shall carryout the necessary amendment within a week.
Rule is made absolute.
