Heard learned counsel for the applicant, learned counsel for the opposite party no. 2 and learned A.G.A. for the State.
This application u/s 482 Cr.P.C. has been filed with the prayer to quash the entire proceedings of S.S.T. No. 70 of 2019, arising out of Case Crime no. 166 of 2018, under Sections 353, 294, 504, 506 I.P.C. and Section 3(1)(r) and 3(1)(s) ST/ST Act, P.S. Bhawarkol, district-Ghazipur, pending in the court of Second Addl. Sessions Judge/Special Judge (SC/ST) Act, Ghazipur, as well as chargesheet dated 25.11.2018.
Learned counsel for the applicant submitted that although the dispute between the parties has been amicably settled as would be evident from the compromise entered between them, copy whereof has been filed as Annexure-1 to the short counter.
In view of the fact the parties do not want to pursue the case any further as stated by them and the fact that matter is purely of personal nature, which has been mutually settled between the parties in view of the compromise, no useful purpose would be served in proceeding with the matter further:
Thus in view of the well settled principles of law as laid down by the Hon'ble Apex Court reported in (2012) 10 SCC 303; Gian Singh vs. State of Punjab and 2014 AIR SCW 2065; Narinder Singh and others vs. State of Punjab and Another.
The present application is accordingly allowed as prayed.
