Learned counsel for the petitioner argues that despite entitlement, the benefit of notional pay scale is not being given to the petitioner. The petitioner claims to have represented the matter before respondent no. 2, however no decision is being taken thereupon.
Considering the fact that grievance of the petitioner is to be decided by respondent no. 2, Director General, Medical and Health Service, Lucknow at the first instance, the present petition is disposed of with liberty to the petitioner to file a fresh representation before respondent no. 2 along with copy of the order. Respondent no. 2 shall consider and pass appropriate orders on the said representation expeditiously, preferably within a period of three months from the date of filing of the representation.
