Heard learned counsel for the petitioner.
Only prayer made in the present petition is to issue a direction to the Court below to decide the temporary injunction application under Order 39 Rule 1 CPC pending in Original Suit No. 218 of 2018 (Smt. Rajni Gupta vs. Smt. Chandrawati and others), within stipulated period.
It is contended that the contesting defendant no. 1 had appeared in the suit on 3.12.2018 but objection to the temporary injunction application has yet not been filed. It is contended that other defendants are only formal parties.
Be that as it may, having perused the order sheet, without expressing any opinion as to the merits of claim of the petitioner, the present petition is being disposed of with the direction to the Court below namely the Civil Judge (Senior Division), Firozabad to decide the temporary injunction application under Order 39 Rule 1 CPC pending in Original Sut No. 218 of 2018 (Smt. Rajni Gupta vs. Smt. Chandrawati and others), as expeditiously as possible, from the date of submission of certified copy of this order, after giving due opportunity to the contesting defendant no. 1 to file her objection.
