Heard learned counsel for the applicants and learned A.G.A. for the State respondent.
The present application has been filed for quashing of the proceedings of Complaint Case No. 97 of 2010 (Rakesh Vs. Rajneesh & others), under Section 4 of Dowry Prohibition Act, Police Station - Bever, District - Mainpuri, pending before Judicial Magistrate, Court No. 2, Mainpuri and also for quashing of the summoning order dated 25.03.2010 passed by learned Judicial Magistrate, Court No. 2, Mainpuri.
It is contended by the learned counsel for the applicants that the present proceeding against the applicants is nothing but a counter blast to the proceedings initiated by the applicants' side against the opposite party no.2. This counter blast proceedings have been initiated after eight months of the initiation of the proceedings against the opposite party no. 2 and the same is bad in law.
Issue notice to opposite party no. 2 returnable within four weeks. Steps be taken within a week.
Learned A.G.A. prays for and is granted four weeks' time to file counter affidavit. The opposite party no. 2 may also file counter affidavit within the said period. As prayed by the learned counsel for the applicant two weeks thereafter is granted for filing rejoinder affidavit.
List after expiry of the aforesaid period before appropriate Court.
Till the next date of listing no coercive steps shall be taken against the applicants in the aforesaid case.
