Rajneesh Kumar vs State Of U P And Another

JUDGMENT / ORDER

Court No. - 32
Case :- WRIT - C No. - 24993 of 2020 Petitioner :- Rajneesh Kumar (Minor) Respondent :- State of U.P. and Another Counsel for Petitioner :- Basant Kumar Chauhan,Ram Janam Singh Counsel for Respondent :- C.S.C.
Hon'ble Rohit Ranjan Agarwal,J.
1. Heard Sri Basant Kumar Chauhan, learned counsel for the petitioner and learned Standing Counsel for the respondents.
2. Pursuant to the order dated 17.03.2021, learned Standing Counsel has placed before the Court original answer copies of subject Mathematics, English and Social Science of High School Examination and from perusal of the same it appears that the Examiner had examined the copies and awarded marks on each and every answer. The copies are returned to the learned Standing Counsel.
3. The grievance of the petitioner is that in the Science, Mathematics and Social Science subjects, marks have been awarded collectively and the Examiner has not awarded marks individually to the sub-part of the answer. Thus, the petitioner could not come to know as to how much marks he had obtained for individual part of the answer. Counsel for the petitioner further submitted that though the answer given by the petitioner was correct but full marks has not been awarded by the Examiner and therefore, matter may be referred to some Expert in the subject and the copy may be revalued.
4. Having heard learned counsel for the parties and from perusal of material placed before the Court, it transpires that each and every answer was checked by the Examiner and marks were awarded collectively in all the individual parts of the answer given by the petitioner. So far as request for getting the answer sheet revalued by some other Examiner is concerned, there is no such provision in the Board of High School and Intermediate Uttar Pradesh for revaluation and the only remedy available is for scrutiny, which the petitioner had already availed.

5. In view of the above, the relief prayed by the petitioner cannot be granted.
6. The writ petition fails and is hereby dismissed.
