Heard learned counsel for the applicant and learned A.G.A. for the State.
The present 482 Cr.P.C. has been filed against the order dated 31.1.2018, by which the learned Session Judge has set aside the order dated 30.6.2017 passed by the Sub Divisional Magistrate, Madiyahu, Jaunpur, under Section 133 Cr.P.C. and has remitted the matter to that authority to decide a fresh.
Learned counsel for the applicant submits that though the civil suit is pending, however, the said civil proceeding has no concern with the public path in dispute in the present proceeding.
At present, the proceedings have only been remanded and there is no observation on the merits.
In view of the above, the present 482 Cr.P.C. application is disposed of with a direction to the Court below to decide the case, upon remand, as expeditiously as possible, preferably within a period of two months from the date of the production of a certified copy of this order.
