Heard Sri Maohammd Nadeem, learned counsel for the applicant and Sri M.P. Singh Gaur, learned AGA appearing for the State.
The contention is that proceedings under Section 125 Cr.P.C. are set down ex parte and an application to set aside the same and to grant liberty to the applicant to participate in the proceedings has been rejected by means of the impugned order dated 04.06.2018 in the absence of learned counsel appearing on behalf of the applicant-husband. The order dated 04.06.2018 is virtually an order rejecting the application for recall paper no. 7B for non prosecution.
The applicant may, therefore, make an application seeking recall of the order dated 04.06.2018, and, if restored, press application paper no. 7B in accordance with law.
