By means of the present petition, petitioner is seeking consideration of his claim of keeping transfer order in abeyance till the conclusion of investigation in Criminal Case No. 15/2018 at Police Station Chopan and further till other inquiry initiated by the Departmental Authorities, are concluded.
Submission with regard to the inquiries going on against the petitioner in present petition are vague. The date of transfer order is not disclosed in the writ petition.
It appears that the petitioner was initially transferred from Sonebhadra to Pratapgarh. The order dated 30.7.2017 staying the transfer order till 30.4.2018 has been passed in the light of the fact that some other inquiries were going against him.
In view of the fact that the assertions in the present petition with regard to the inquiries going on against the petitioner are vague and further that the petitioner has represented the higher authority for staying the transfer order, it would be appropriate that the petitioner first join the transferred place and then make a fresh representation.
In case, the petitioner joins at the transferred place of posting soon after 30.4.2018, it would be open for him to file a fresh representation before respondent no.5, who shall take appropriate decision in accordance with law.
With the above noted facts, the writ petition is, accordingly, disposed of.
