The appellant has filed this appeal against the order dated 18.1.2019 deciding Writ C No. 1667 of 2019 (Shiv Kumari Verma Vs. State of U.P. and 3 others).
The writ Court by the said order has directed the appellate authority to decide the appeal of respondent no. 1 Shiv Kumari Verma expeditiously within four months and the order dated 30.12.2018 directing for recovering some amount has been quashed.
The appellant was not the party in the said writ petition.
The appellant contends that he is a person aggrieved as it was on her complaint that the proceedings against respondent no. 1 Shiv Kumari Verma were initiated.
A person making a complaint has no locus standi to challenge the final outcome of the enquiry made on the basis of his/her complaint. At best he/she can adduce evidence and help the enquiry officer in submitting the enquiry report.
In view of the above, we are of the opinion that the appellant is not a person aggrieved if any direction is issued to decide the appeal of respondent no. 1 Shiv Kumari Verma and by the quashing of the recovery.
In view of the aforesaid facts and circumstances, the Special Appeal is misconceived and is dismissed.
