Heard Mr. Neeraj Kumar Srivastava, learned counsel for the petitioner and Mr. Mahboob Ahmad, learned counsel for respondent Nos. 2 and 3.
This petition impugns the order dated 27.11.2017 by which petitioner's application, for LPG Distributorship at Mughalsarai (MB) District Chandauli, under S.C. category, advertised on 22.10.2011, has been rejected as he was not found eligible. The grounds on which his application came to be rejected read thus:
"a. You could not offer land for showroom with date of registered sale deed/gift deed/lease deed earlier than the date of submission of the application. You were asked to provide alternate land as per the policy, but you were not able to provide alternate land/shop for showroom. The offered showroom land has been eased at a date later than the application submission date.
b. You could not offer land for godown with date of registered sale deed/gift deed/lease deed earlier than the date of submission of the application. You were asked to provide alternate land as per the policy, but you were not able to provide alternate land for godown. The offered godown land has been leased at a date later than the application submission date.
c. You have shown saving account (20398264187) in the joint names of self and your husband at ALLAHABAD BANK, VARANASI with Rs. 501686/- in the Application form. Total value verified as on date of Application in above saving bank is Rs. 52804/- only. This amount is less than the amount required for eligibility. You were asked to provide alternate fund as per the policy, but you were not able to provide the alternate fund as on date of application."
Counsel for the petitioner could not produce any material on record to show that the petitioner had sufficient balance in his bank account on the date of application i.e. 2.9.2011 and he maintained the balance till the last date of application i.e. 23.11.2011. Even in respect of the first two grounds also, he could not bring any material on record to show that he offered suitable land for showroom or for godown. In the circumstances, we find no merit in the writ petition. Petition is dismissed.
