Heard learned counsel for the petitioner and learned Standing Counsel for the State-respondents.
The writ petition has been filed seeking the following relief:-
"(A) Issue a writ order or direction in the nature of mandamus commanding/directing the respondent no. 2 i.e. Sub Divisional Magistrate, Tehsil - Handia, District Allahabad to decide the restoration application dated 5.5.2018 computerized No. T2014020304697 of 2018 (Sita Devi Vs. Gaon Sabha Gaharpur and others) as expeditiously as possible."
The petitioner is aggrieved as his restoration application filed against a decree of the trial court in a declaratory suit decreeing the same has not been decided since 05.05.2018.
Under the circumstances, this writ petition is disposed of with a direction to the respondent no. 2 i.e. Sub Divisional Magistrate, Tehsil - Handia, District Allahabad to decide the restoration application as expeditiously as possible, preferably within a period of three months from the date a certified copy of this order is filed before him.
