Hon'ble Jaspreet Singh,J.
Heard Sri G. S. L. Verma, learned Counsel for the petitioners, Sri Raj Kumar Singh, learned counsel for respondent No.1 and Sri Prakhar Mishra, leaned Standing Counsel for respondent Nos.5 and 6.
None responds for respondent No.2/National Highways Authority of India (NHAI).
By this writ petition, the petitioners are assailing the Award passed by the Collector/Arbitrator, Sultanpur under Section 3G(5) of National Highways Act, 1956 and Section 23 (1) of The Arbitration and Conciliation Act, 1996.
In case the petitioners are aggrieved by the aforesaid Award, then the proper remedy available to the petitioners is to file an application under Section 34 of the Arbitration and Conciliation Act, 1996 challenging the Award of the Arbitrator.
In view of above, we grant liberty to the petitioners to challenge the Award which is impugned in the writ petition by taking recourse to Section 34 of the Arbitration and Conciliation Act, 1996.
With the aforesaid liberty, we dismiss this petition.
