This is the petition filed by the defendants Ist set who are contesting defendants in Original Suit No.145 of 2017 (Main Bahadur Singh & another Vs. Ramjani Singh & others). Only prayer made by learned counsel for the petitioners is that the objection to the temporary injunction filed by the petitioners/defendants has yet not been decided. An exparte injunction granted in favour of the plaintiffs is being extended from time to time, in view of the pendency of the temporary injunction application which is causing prejudice to the defendants. It is evident from the records that the Amin commission report has been filed in the court below on 29.10.2018.
Considering the said facts, having perused the order sheet, without expressing any opinion as to the merits of the claim made by the petitioners, the present petition is being disposed of with the direction to the court below that it shall grant adequate time to the parties to file objection to the Amin commission and decide the temporary injunction application (6-C) pending in Original Suit No.145 of 2017 (Main Bahadur Singh & another Vs. Rajmani Singh & others), expeditiously on the next date fixed or on a short date to be fixed within further period of four weeks considering the objections of the parties on the Amin Commission report.
