An affidavit of compliance has been filed sworn by opposite party no.1. According to the said affidavit, in compliance of order of the Writ Court, a sum of Rs.2,33,344/- has been paid to applicant no.1 and a sum of Rs.1,89,044/- has been paid to applicant no.2.
Counsel for the applicants states that in respect of applicant no.2, there is a shortfall of about Rs.11,000/- and odd towards annual increment and dearness allowance. He further states that because of the pending dispute, the pension of the applicants is also not being paid.
Sri B.P. Singh, learned counsel appearing on behalf of opposite party states that the pension papers of the applicants shall be duly forwarded to the concerned authority without any delay.
Since order of the Writ Court has been substantially complied with, therefore, this Court finds no good ground to proceed any further in the instant matter. However, it is left open to the applicants to represent before the first respondent regarding shortfall in payment of arrears to the tune of Rs.11,000/- and odd by filing separate representation and in which event, the same shall be decided by him, by means of a speaking order.
The contempt application stands disposed of accordingly.
