JUDGMENT / ORDER

Heard Mr.Divyesh Sejpal, learned advocate for the petitioner. It is submitted by him that the impugned order dated 09.01.2012, passed by the Secretary (Appeals), Revenue Department, suffers from non-application of mind, inasmuch as a salient aspect of the matter has been ignored that respondent No.2 has withdrawn his consent for swapping his plot with respondent No.1, on 04.04.2008, by swearing an Affidavit and giving an application. That, without taking this aspect into consideration, the Secretary (Appeals), Revenue Department, has confirmed the order of the Collector, whereby it has been directed that the plots of respondents Nos.1 and 2 be swapped.
Notice returnable on 26.03.2012.
Status-quo, as it exists today, qua the plots of respondents Nos.1 and 2, be maintained till then.
In addition to the normal mode of service, Direct Service is also permitted.
