Heard Sri Ajendra Kumar, learned counsel for the petitioner, learned Standing Counsel for the State-respondent nos.1 and 2 and perused the record.
By means of the present petition, the petitioner has questioned the order dated 2.8.2018 whereby the Insurance Company rejected the claim of the petitioner on the ground that the petitioner being not the dependent upon the son, she is not entitled for claim.
Learned counsel for the petitioner submits that the petitioner has already approached the District Magistrate concerned regarding his grievance by moving representation dated 13.8.2019 which has been sent to the District Magistrate by the registered post dated 13.9.2019, copy whereof is appended as Annexure No.3 to the writ petition. He states that the District Magistrate can look into the matter and decide the same as the Insurance Company has refused to grant compensation under the relevant scheme of State Government.
Learned Standing Counsel representing the respondent submits that he has no objection if direction is issued to the District Magistrate to consider the representation/application of the petitioner dated 13.8.2019 strictly in accordance with law.
In such view of the matter without entering into merits of the case and without observing regarding genuineness of the claim set-up by the petitioner, we dispose of the writ petition with the direction to the District Magistrate/Collector concerned to look into the grievance of the petitioner as has been raised in the representation dated 13.8.2019 (annexure no.4 to the writ petition) and pass appropriate order strictly in accordance with law as expeditiously as possible, preferably within a period of three months from the date of production of certified copy of the order.
The writ petition is disposed of accordingly.
