Heard Sri Arjun Singhal, learned counsel for the petitioner and the learned Standing counsel.
The petitioner has preferred this petition seeking direction that the respondents be restrained from operating Pashu Chedan and Charma Shodhan work on the land of khasara no. 134 of village Bhadal, District Baghpat. There is no dispute to the fact that the aforesaid land is the land of the Gaon Sabha and is recorded in the revenue record as the land for skinning the animals.
The Sub-Divisional Officer by the order dated 16th August 2017 in order to facilitate the work of skinning of the animals has permitted installation of a submersible pump and the construction of a platform, drain and soak pit on the said land.It is in view of the above that the petitioner contend that the public utility land is being mis-utilized.
We do not agree with the above submission of learned counsel for the petitioner as the installation and the construction of all the above things are a step in helping the skinning of the animals for which purpose the said public utility land is reserved as per the revenue records.
This apart, petitioner is not a person aggrieved in any way by such action of the SDO. Merely because he happens to be the villager he has no locus to intervene in the matter.
The writ petition is accordingly dismissed.
