This revision was filed against order dated 30.1.1999, passed by Special Judge (D.A.A.)/Addl. District and Sessions judge, Farrukhabad in Criminal Revision No. 46 of 1996 (Smt. Sunita Devi Vs. Rajiv Kumar) whereby Rs. 500/- per month was granted as maintenance allowance to the O.P. No. 2- Sunita Devi.
Learned AGA submits that there is no illegality or infirmity in the impugned order.
From perusal of record, it transpires that O.P. No. 2- Sunita was wife of revisionist- Rajiv Kumar. As per record, revisionist- Rajiv Kumar was a government servant at that time and was posted at Reserve Police Line, Allahabad.
In my view, maintenance, granted in favour of O.P. no. 2- Sunita, is neither excessive nor improper.
No illegality or infirmity is found in the impugned order.
This revision is accordingly, dismissed. Stay order, passed by this court vide order dated 17.4.1999, stands vacated.
