JUDGMENT / ORDER

The first petitioner's vehicle, a lorry, bearing registration No.KL-42-E-3624, second petitioner's vehicle, a lorry, bearing registration No.41-C-1532, third petitioner's vehicle, a lorry, bearing registration No.KL-06-E-271 and the fourth petitioner's vehicle, a HITACHI have been seized alleging transportation of ordinary earth without permit. Petitioners' case is that they have removed earth from the site covered by the building permit and the Geologist has issued 'P' form. The learned Government Pleader submits that the petitioners removed the earth not from the site covered by the building permit and they removed the earth from the other area. Considering the facts and circumstances, there shall be a direction to the respondents to release the vehicles on executing bond with two solvent sureties each. However, the respondent is free to proceed WP(C).No.31765/2014-U.
2 against the petitioners by filing complaint under Section 22 of the Kerala Mines and Minerals (Development and Regulation) Act, 1957.
The Writ Petition is disposed of as above.
