JUDGMENT / ORDER

Rule.
Learned counsel Mr. S.M. Shah waives service of rule for the opponent.
Heard learned advocate Mr. Devang Dave for the applicant-appellant and learned counsel Mr. SM Shah for the opponent-original respondent.
In view of the contentions raised with regard to the agreement to sell, the matter has been already admitted and it requires a detailed hearing. Therefore, in the interest of justice, prayer in terms of para 8(B) is granted. The impugned judgment and decree passed by the Principal Sr. Civil Judge, Bhuj-Kutchh in Special Civil Suit No. 17/2007 is hereby stayed till the final hearing of the present First Appeal. The parties are directed to maintain status-quo with regard to the disputed property in question.
Rule made absolute.
