JUDGMENT
[JUDGMENT OF THE COURT WAS DELIVERED BY C.T.SELVAM, J] This Civil Miscellaneous Appeal has been preferred against the judgement and decree dated 18.09.2013 made in O.P.No.1730 of 2010 on the file of the II Additional Family Court, Chennai seeking decree of divorce under Section 13(1)(i-a) of the Hindu Marriage Act.
2. Before Family Court, while the petitioner examined himself as PW-1 and marked three exhibits, the respondent and one another examined themselves as RWs-1 & 2 and no exhibits were marked.
3. On appreciation of materials before it, Family Court, under judgement dated 18.09.2013, granted a decree of divorce on the ground of cruelty in O.P.No.1730 of 2010. There against, appellant/wife has preferred this appeal.
4. Pending this appeal, the matter has been referred to Mediation and Conciliation Centre attached to this Court. The Mediation report dated 24.01.2017 informs the following agreement:-
1. It is agreed by both the parties that there is no possibility for re-union.
2. The Respondent agreed to pay a sum of Rs.1,45,000/- (Rupees One Lakh Forty Five Thousand only) by way of three Demand Drafts bearing Nos.495857, 495858 and 495859 dated 23.01.2017 drawn on Tamil Nadu Mercantile Bank, Mylapore Branch and Rs.10,000/- by cash towards the permanent alimony to the Appellant and also paid the said amounts on 24.01.2017 and the Appellant also acknowledges the same.
3. The Respondent also today handed over the Gold Ring to the Appellant.
4. Both parties have no other claims against each other.
5. In the light of the said agreement, the Civil Miscellaneous Appeal shall stand dismissed. The Mediation Report along with agreement shall form part of the judgment.
