Learned counsel for the petitioner is permitted to amend the array of parties.
Heard learned counsel for the petitioner and learned Standing Counsel for the State.
At the very outset Sri Arvind Kumar Mishra, learned counsel for the petitioner concedes that there exists an alternative remedy against the order of cancellation of fair price shop license. The only prayer made by the learned counsel for the petitioner is that the petitioner proposes to file an appeal and the same may be decided within a stipulated time frame.
Learned Standing Counsel has no serious objection to the aforesaid prayer.
In view of the submissions advanced at the Bar, in case petitioner filed an appeal within a period of one month from today before the competent authority, the same shall be decided within a further period of three months from the date of receipt of certified copy of this order. It is clarified that in case, an appeal is not filed within the aforesaid period, the direction to decide the appeal shall stand recalled.
With aforesaid observations present writ petition stands disposed of.
