The instant application has been filed u/s 482 of Code of Criminal Procedure (Code) for quashing the summoning order dated 3.9.2019 and entire proceeding of Complaint Case No. 3944 of 2017 (Dropadi Devi Vs. Rajeshwari Devi), against applicants No. 1 to 3, u/s 452, 323 I.P.C. and against applicants No. 4 & 5 u/s 452, 323, 354 I.P.C., P.S. Bisalpur, District Pilibhit.
Heard learned counsel for the applicants, learned A.G.A. for State and perused the record.
After making some argument, learned counsel for applicants submits that he is not pressing the application on merit. It is further submitted that some more time be provided to the applicants to surrender before the Court and apply for bail.
In view of submission made by learned counsel for applicants, prayer for quashing the entire proceeding of Complaint Case No. 3944 of 2017 (Dopadri Devi Vs. Rajeshwari Devi) is refused.
However, it is provided that if the applicants appear or surrender before the Court concerned within 30 days from today and apply for bail in the aforesaid case, their prayer for bail shall be considered as expeditiously as possible by the court below in accordance with law.
With aforesaid direction, the instant application stands disposed off.
