Common Judgment: (per the Hon’ble the Chief Justice Sri Kalyan Jyoti Sengupta) After hearing the learned counsel for the parties, we dispose of the contempt appeals as the contemnor has given an undertaking before us by remaining present personally that he would appear personally on the first available date when the Hon’ble trial Judge will take up these matters and explanation of his earlier lapses in appearance will be sympathetically considered by the Hon’ble trial Judge. It is desirable that his applications for dispensation of personal appearance would also be considered by the Hon’ble trial Judge on that date.
In view of this undertaking, we keep the warrants of arrest in abeyance. In case of failure to appear before the Hon’ble trial Judge, as undertaken before us, the warrants of arrest will be executed forthwith and also liberty is given to draw up fresh proceedings for committing breach of contempt before this Court.
The contempt appeals are accordingly disposed of. Pending miscellaneous applications, shall also stand disposed of. No costs.
