The sole relief claimed in the instant petition is for issuing a mandamus commanding the District Judge, Agra before whom Misc. Appeal No.168 of 2018 is pending at the instance of the petitioner, to decide the stay application filed therein, preferably within three months.
He has also sought a mandamus commanding the respondents not to create any hindrance in use of tractor of the petitioner.
Counsel for the petitioner admits that the court before whom the appeal is pending, is lying vacant. In such view of the matter, this Court is not inclined to issue any direction at this stage but it is hereby provided that as soon as the Presiding Officer is posted, he shall endeavour to decide the stay application expeditiously taking into consideration the stand of the petitioner that a final report has already been submitted by the police.
