[1] This application is preferred by the applicant to release him on temporary bail for a period of 45 days in connection with C.R.No.I-78 of 2011 registered with Manjalpur Police Station, Vadodara.
[2] It is submitted by Mr.N.D.Nanavaty, learned senior advocate for the applicant that regular bail application preferred by the applicant has been rejected by the Hon'ble Supreme Court. It is also submitted that in view of the order dated 04.01.2012 passed by the Hon'ble Supreme Court, the applicant is supposed to deposit Rs.95,20,000/- before the Bombay High Court on or before 04.04.2012. It is further submitted that arrangement of funds can be made by the applicant, only if he is released on temporary bail. It is also submitted that passport of the applicant is with the CBI. Therefore, it is submitted that applicant may be released on temporary bail with strict conditions.
[3] Having heard learned Senior advocate for the applicant and learned APP and considering overall facts and circumstances, the applicant is granted temporary bail for a period of two weeks, from the date of his release, on furnishing a personal bond of Rs.25,000/- (Rupees Twenty five Thousand Only) with like amount of surety before the Trial Court and on condition that the applicant shall mark presence before Malbhar Hill Police Station, Mumbai twice during the temporary bail period i.e. within 5 days of his release and 5 days thereafter any time between 11.00 a.m. and 2.00 p.m. and on condition that on completion of the period of three weeks of temporary bail, the applicant shall surrender in time before the jail authority. It is also clarified that no further extension will be granted.
[4] With the aforesaid directions, this application is partly allowed.
[5] Copy of this order be send to Malbhar Hill Police Station, Mumbai. Direct service is permitted.
