JUDGMENT / ORDER

Heard Mr.Tarak Damani, learned advocate for the applicant and Mr.Maulik Nanavati, learned Additional Public Prosecutor for the respondent-State.
The instant application is filed seeking temporary bail for the period of 45 days in connection with FIR being I- C.R. No.78/2011 registered with Manjalpur Police Station, District:Vadodara regarding the offences punishable under Section 406 and 409 of the Indian Penal Code.
Mr.Tarak Damani, learned advocate for the applicant submitted that pursuant to the order passed by the learned Chair Person, DRT, Mumbai, Annexure-E, the applicant has to deposit his dues approximately of Rs.130 Crores in four installments of Rs.32.5 Crores each and for that purpose, it is submitted that the applicant may be released on temporary bail.
Mr.Tarak Damani, learned advocate for the applicant, further submitted that in past, vide order dated 30.03.2012, passed in Criminal Misc.Application No.3257 of 2012, almost on identical ground for the purpose of making arrangement of funds for depositing the installment amount, the applicant was released on temporary bail for two weeks on certain terms and conditions.
Heard Mr.Maulik Nanavati, learned APP for the respondent-State.
Having considered the facts and circumstances of the case, so also contents of the application, order at Annexure-E and earlier order passed in Criminal Misc.Application No.3527 of 2012, this Court is of the opinion that the application deserves to be partly allowed.
For the foregoing reasons, the application is partly allowed and the applicant is ordered to be released on temporary bail up to 5th July, 2012, from the date of his actual release on his furnishing personal bond of Rs.25,000/- with like amount of surety before the Trial Court on condition that the applicant shall mark presence before Malbhar Hill Police Station on every Monday and Thursday during the period of his temporary bail on any time between 11.00 a.m. to 2.00 p.m. and on condition that on completion of the period of temporary bail, the applicant shall surrender in time before the jail authority on 06.07.2012. It is clarified that no further extension will be granted.
Application stands disposed of. Rule made absolute accordingly. Direct service is permitted. Direct service is permitted, today.
