1. By virtue of common oral order dated 28.06.2012 while disposing these applications, this Court directed to learned Sessions Judge to expedite trial of the Sessions Case and to dispose of the said case as earlier as possible preferably within four months from the date of communication of this order. The liberty of the applicant was also reserved to apply for bail in future, if the trial of the sessions case is delay.
2. Today, the Registry has placed a communication dated 19.10.2012 before this Court, made by concerned learned Additional Sessions Judge, Gondal, addressed to Registrar General of this Court, wherein the concerned learned Sessions Judge has stated that due to heavy administrative work and other under-trial cases, sessions case could not be disposed of within four months. The learned Sessions Judge, therefore, requested that some more time, at least of six months, be granted to dispose of the matter.
3. Heard Mr.Virat Popat, learned advocate for the applicant and Mr.R.C.Kodekar, learned APP for the respondent-State.
4. Considering the facts and circumstances of the case, so also considering earlier common oral order dated 28.06.2012 passed in above referred two bail matters, this Court is of the opinion that appropriate time should be granted for the disposal of the concerned sessions case.
5. For the foregoing reasons, request for extension of time made by learned 3rd Additional Sessions Judge, Gondal, in her letter dated 19.10.2012 is partly granted and it is hereby directed that the learned Additional Sessions Judge shall dispose of said sessions case in accordance with law within three months from the date of receipt of the communication of this order. It is hereby further directed that the liberty of the applicants to apply for bail in future in case of any difficulty is expressly reserved.
6. Registry to communicate this order to the concerned Sessions Court forthwith. Communication dated 19.10.2012 made by learned 3rd Additional Sessions Judge, Gondal, stands disposed of accordingly.
